Level Up Goal Tracker Terms of Service

Welcome to Level Up Goal Tracker! These Terms of Service ("Terms") govern your use of the mobile application ("App") provided by Level Up Goal Tracker ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
Account Registration
1.1 To use the App, you must create an account and provide accurate and complete information, including your email address.
1.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Goal Tracking and Data Privacy
2.1 The App allows you to set and track personal goals. We collect and store the information you provide, including your goals, progress, and any additional data you choose to input.
2.2 We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using the App, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.
Payment and Subscriptions
3.1 If you choose to access premium features or subscribe to a paid plan, you agree to pay the applicable fees as outlined in the App.
3.2 Payments are processed securely via the Google Play Store or Apple App Store, depending on the device. We do not collect or store any payment information, including credit card or other financial details. All transactions are handled by trusted third-party payment processors.
3.3 Subscriptions will automatically renew unless canceled before the end of the current billing cycle.
3.4 We reserve the right to modify our pricing and subscription plans. In the event of any changes, we will notify you in advance and provide you with an opportunity to cancel your subscription if you do not agree to the new terms.
Intellectual Property
4.1 The App, including its design, features, and content, is protected by intellectual property laws and is owned by or licensed to Level Up Goal Tracker.
4.2 You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the App without our prior written consent.
Prohibited Conduct
5.1 You agree not to engage in any of the following prohibited activities while using the App:
- Violating any applicable law, regulation, or third-party rights.
- Interfering with or disrupting the functionality of the App or servers.
- Attempting to gain unauthorized access to any part of the App.
- Uploading or transmitting any viruses, worms, or malicious code.
- Engaging in any activity that imposes an unreasonable burden on our infrastructure.
- Engaging in any fraudulent, abusive, or unethical behavior.
Disclaimer of Warranties
6.1 The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
6.2 We do not guarantee the accuracy, completeness, or reliability of any content available through the App. You acknowledge that your use of the App is at your own risk.
Limitation of Liability
7.1 To the maximum extent permitted by applicable law, in no event shall Level Up Goal Tracker or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
7.2 Our total liability in connection with your use of the App shall not exceed the amount paid by you for accessing premium features or subscribing to a paid plan within the six (6) months preceding the event giving rise to the liability.
Indemnification
8.1 You agree to indemnify and hold Level Up Goal Tracker and its affiliates, directors, officers, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, violation of these Terms, or infringement of any rights of a third party.
Termination
9.1 We may, at our sole discretion, suspend or terminate your access to the App at any time and for any reason, including but not limited to a breach of these Terms or if we believe that your use of the App poses a risk to us, other users, or violates applicable laws or regulations.
9.2 Upon termination, all rights granted to you under these Terms will cease, and you must immediately cease all use of the App.
Changes to the Terms
10.1 We reserve the right to modify or update these Terms at any time. We will notify you of any material changes to these Terms via the email address associated with your account or through the App. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
Governing Law and Dispute Resolution
11.1 These Terms shall be governed by and construed in accordance with the laws of The United States of America.
11.2 Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in The United States of America.
Severability
12.1 If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
13.1 These Terms constitute the entire agreement between you and Level Up Goal Tracker regarding your use of the App and supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written.
